WEEKLY RENTALS
The rental of all properties advertised by ISLAND OF SARDINIA SRL has the legal nature of a “Tourist Lease” and is concluded by ISLAND OF SARDINIA SRL on behalf of the respective owners under their express authorization, in compliance with the terms and conditions set out in the private agreement signed with the owners themselves.
The properties must be considered Private Structures, as the owner rents the property as a private individual and not as a hospitality business with specific hotel or similar licenses, and therefore cannot provide accessory hotel-type services. As these are private holiday homes, they do not have internationally recognized standards or categories, but rather reflect in their architecture and furnishings the local traditions and the personal taste of the owner. Island of Sardinia Srl (operating as the “Company”) advertises villas, houses, and apartments (“properties”) as an agent and on behalf of the property owners (“Owner”).
All properties are previously inspected by the Company to ensure that they meet the standards of accommodation on which the Company’s reputation is based. At the time of listing’s publication, the properties are furnished and equipped as described in detail and in the technical information provided to renters (“Clients”) on the Company’s website or partner websites.
Should the property owner decide to modify the layout, furniture, or accessories present in the property, the Company will update the website information if such modifications alter the nature of the accommodation. Any differences between the description, the photos on the website, and such modifications made on-site by the owner will not be considered valid grounds for cancellation, refund, or any other type of claim against the Company. Furthermore, the Company will not be held responsible to Clients in the event of modifications made by the Owner that were not communicated to the Company.
The prices published on the Company’s website are indicative and subject to change without notice before booking confirmation. A quotation will be provided upon inquiring. The booking will only be confirmed after payment of the required deposit.
RENTAL PERIOD – ISLAND OF SARDINIA SRL
The Company manages short-term rentals which generally, especially in high season and depending on the type of villa requested, require a minimum stay of 7 nights with Saturday arrivals and departures. Any other request will be evaluated on a case-by-case basis.
During the “low season” it is possible to book stays shorter than 7 nights and with arrivals and departures not necessarily on Saturdays.
BOOKING PROCEDURE
All bookings are provisional until confirmed.Once the availability of the property for the requested period has been confirmed, ISLAND OF SARDINIA SRL will send confirmation of the booking to the Client by email, along with payment instructions for the deposit. The reservation will only be considered confirmed after receipt of the required deposit within the time frame specified by ISLAND OF SARDINIA SRL, i.e. within 2 days from receipt of the confirmation email.
In case of payment by bank transfer, proof of payment must be sent as confirmation. Credit card payments will be subject to a 3% administrative fee. Failure to pay the deposit within the specified time frame will result in automatic cancellation of the booking.
The balance of the booking must be paid:
90 days before arrival for villas in the “Exclusive” selection,
60 days before arrival for villas with 4 or more bedrooms and/or private pools,
30 days before arrival for villas with up to 3 bedrooms and/or villas with shared pools.
Failure to pay the balance by the due date will result in cancellation of the booking by ISLAND OF SARDINIA SRL, in accordance with the cancellation policies.
CANCELLATION TERMS
Cancellations will only be considered effective if requested in writing and confirmed by Island of Sardinia Srl, or in case of failure to pay the deposit and/or balance within the agreed terms. If the Client decides to cancel the booking, the following penalties will apply:
Properties with up to 3 bedrooms and7or shared pool
31 days or more prior to arrival: 30% of the rental price (deposit) will be retained.
From 30 days up to the arrival date: 100% of the total booking amount will be retained.
Properties with 4+ bedrooms and/or private pool:
- 61 days or more prior to arrival: 30% of the total rental price will be retained.
- From 60 to 46 days prior to arrival: 70% of the total booking amount will be retained.
- From 45 days prior to arrival up to the arrival date: 100% of the total booking amount will be retained.
Exclusive Properties:
91+ days before arrival: 30% of the rental price (deposit) will be retained.
From 90 to 61 days before arrival: 70% of the total booking amount will be retained.
From 60 days up to the arrival date: 100% of the total booking amount will be retained.
Date, property changes and no-show constitute cancellation of the original booking and cancellation policies will apply. As a gesture of good will, the agency will make reasonable efforts to accommodate requests for a substitute villa, mitigating cancellation terms. However, substitution will only be valid once the agency has provided written details and the Client has accepted the substitution terms, conditions, and any cancellation penalties, service fees, or price differences.
Note: If the cancellation occurs within the eligible refund period, a handling fee of €25.00 plus bank transfer costs will be withheld.
CHECK-IN AND CHECK-OUT
Check-in procedures will begin from 4:00 pm depending on villa availability and subject to the agent’s commitments for check-in. Therefore, villa entry is to be considered between 4:00 pm and 9:00 pm.
For check-in between 9:00 pm and 10:00 pm, a supplement of €30 will be charged.
For late check-in between 10:00 pm and midnight, a supplement of €50 will be charged.
For arrivals expected after midnight, late check-in must be confirmed by our booking office and will be subject to an additional cost up to €150.
We kindly request that you communicate your arrival time at least one week before the check-in. Any change in date or time of arrival must be communicated to ISLAND OF SARDINIA SRL as soon as possible by email or telephone, and will only be considered approved following written confirmation from ISLAND OF SARDINIA SRL staff.
Check-out time is by 10:30 am.
SECURITY DEPOSIT
As the check-in date approaches, a SECURITY DEPOSIT will be requested through a credit card pre-authorization. The amount varies depending on the type of villa (starting from a minimum of €500.00) and will be communicated in writing in advance. The pre-authorization is active up to 28 days; if no damage to the property is found, the amount will be automatically released to your account. During the check-out procedure, an ISLAND OF SARDINIA SRL representative will carry out an initial inspection to verify the condition of the property at the end of the stay. ISLAND OF SARDINIA SRL reserves the right to perform a further and more detailed inspection after the guests’ departure during final cleaning. Should any anomalies due to improper use of the property be found, the Client will be contacted within 72 hours to be informed of the issues detected.
If damages to the property are identified, the entire amount of the security deposit will be temporarily withheld byISLAND OF SARDINIA SRL in order to assess and/or receive an estimate of the repair costs. Any sums exceeding the actual repair cost will subsequently be refunded to the Client. In the event that the damages require the intervention of specialized technical personnel, the repair procedures will include, in addition to the actual cost of damages, a management fee up to a maximum of €150.00.
HOUSE RULES
Once the deposit payment has been made, clients will be able to view the voucher, which represents their contract, in their reserved area. A few days before arrival, instructions on how to reach the property will be provided, and details regarding the expected arrival time and means of transport will be requested in order to better organize check-in.
For the entire rental period, the clients are solely responsible for the property and all of its belongings, both indoors and outdoors (including sunbeds, umbrellas, and other outdoor furniture).
Clients are required to take proper care of the property and strictly comply with local regulations, in particular those concerning waste sorting and disposal. Failure to comply with the waste disposal rules will result in a penalty of up to €250.
The Client acknowledges that the following circumstances will lead to immediate termination of the rental agreement without recourse by the Client and with consequent loss of any sums already paid to the Company:
Exceeding the maximum number of guests indicated in the voucher.
Unauthorized replacement of guests compared to those declared.
Improper or indecorous behavior in the property (including negligent and/or intentional destruction of the property, poor hygiene, excessive noise, etc.).
Parties, weddings, unauthorized events, or events involving persons other than the registered guests declared at check-in.
Bringing pets where not permitted or failing to notify the Company in advance.
The Client acknowledges that no recourse shall be made against the Company or the Owner should such events cause premature termination of the rental agreement.
Guests are kindly requested to adhere to the behavioral norms observed in our country, demonstrating politeness and maintaining courteous and respectful attitude towards both the owner and the property. It is strictly forbidden to move furniture inside the house, to bring interior furniture or furnishings outside (and vice versa), and/or to use them for purposes other than their intended use. Should a guest fail to comply with these rules and/or in the absence of civil and sensible behavior, if damage is caused to the property, its furnishings, or outdoor facilities such as the garden and pool, the Owner shall have the right, at their sole discretion, to terminate the rental agreement through verbal notification to the guest and written notice, for information purposes, to the agency.
The Owner shall also have the right to request the immediate removal of the Client from the property, with the possibility of involving law enforcement.
ISLAND OF SARDINIA SRL declines any responsibility in case of disputes between Client and Owner. In the event of legal action, the Owner will provide the Client with the details of the competent court.
LIABILITY AND CLAIMS
All properties advertised by ISLAND OF SARDINIA SRL have been selected, inspected, and photographed by ISLAND OF SARDINIA SRL. The descriptions published by our company correspond to the actual condition of the properties at the time of the visit and acquisition and have been drafted in good faith.
What ISLAND OF SARDINIA SRL offers the Client is the opportunity to experience and learn about the local customs by spending a holiday in private homes that represent Sardinian tradition and historical heritage. These do not conform to internationally recognized categories but reflect the personal tastes of the Owners.
Therefore, minor shortcomings related to the specific architectural and traditional features of the location cannot be considered grounds for complaints.
ISLAND OF SARDINIA SRL cannot be held responsible if a Client does not find the property to their liking upon arrival, since the Company has provided photos, detailed information, and the best possible description of the property.
Guests are kindly advised that, while some properties may include a bedroom and bathroom adapted for individuals with disabilities or limited mobility, they remain country or seaside homes and may still present certain limitations, including potential architectural barriers.
In the presence of children, clients are advised to carefully review the descriptions and photos of the properties and to request further details from ISLAND OF SARDINIA SRL’s booking office staff in order to ensure that the chosen property is suitable in case of particular needs.
ISLAND OF SARDINIA SRL cannot be held responsible if a Client has not carefully read the website description or has failed to contact the booking office to request additional information.
If upon arrival or during the stay the Client notices serious inaccuracies in the description of the property, or if problems arise that cannot be solved or minimized, they must contact ISLAND OF SARDINIA SRL Customer Service at +39 3423633722. The Client must confirm any complaint in writing within 12 hours of arrival at the property or upon identifying the issue, by email at info@sardiniaunlimited.com. ISLAND OF SARDINIA SRL will make every effort to resolve the problem as quickly as possible to ensure a pleasant stay.
ISLAND OF SARDINIA SRL reserves the right to verify, on-site and during the guests’ stay, through its representative, the reasons for the complaint and any inaccuracies on the part of the Owner, both outside and inside the property.
Any report submitted to ISLAND OF SARDINIA SRL will be reviewed by the Claims Team, which will verify each specific case by consulting the available documentation. A refund claim may be opened exclusively after check-out, in order to allow on-site staff to carry out the necessary inspections of the property during the final cleaning. Only following such inspections, and the subsequent internal assessment by the Claims Team, may the relevant procedure be initiated. Any refunds or compensations will be granted solely if the claim is proven to be based on objective and documented elements, in accordance with our Booking Terms and Conditions. Claims based on subjective evaluations, personal tastes, or individual preferences are expressly excluded.
If a Client submits a complaint after the end of the stay without having contacted ISLAND OF SARDINIA SRL Customer Service during their stay, no refund will be granted.
No refund will be granted to Clients who are removed from the properties at the request of Owners due to lack of communication regarding extra guests or the presence of pets (the number of guests and/or any visiting guests or pets must always be communicated to ISLAND OF SARDINIA SRL and accepted by the Company in agreement with the Owners), or due to failure to pay the required security deposit upon arrival. No refund will be granted to Clients who leave the property before the check out date due to issues or for personal choice without prior written communication to ISLAND OF SARDINIA SRL.
Similarly, no refund will be granted to Clients who did not carefully review the website and therefore found situations unsuitable for them, or who left the property without allowing ISLAND OF SARDINIA SRL’s representative to verify the reason for the complaint.
ISLAND OF SARDINIA SRL does not recognize as valid grounds for complaints events not directly attributable to the agency or the property Owner, such as:
-weather events,
-the presence of local fauna, rodents, or insects (considering the geographical location of the properties),
-power, gas, or water outages due to government regulations,
-external causes or force majeure.
-ISLAND OF SARDINIA SRL declines any responsibility for inconveniences caused by third parties, such as road maintenance works, property renovations, or similar near the rented properties.
-Neither the Owners nor ISLAND OF SARDINIA SRL shall be held liable for personal belongings and/or valuables left unattended inside the property, especially if proper precautions were not taken.
CANCELLATION FROM THE COMPANY
In the event that ISLAND OF SARDINIA SRL is obliged to cancel the client’s booking for reasons beyond its control or due to force majeure, the company shall, in agreement with the client, allocate a new holiday home with characteristics and a standard equivalent to those of the originally booked property.
If the price of the new property is lower than that of the original booking, ISLAND OF SARDINIA SRL shall refund the client the corresponding difference. If, however, the price of the new property exceeds the amount paid by the client by 5% or more, the client, by accepting the proposed property, shall be required to pay the corresponding difference in price to ISLAND OF SARDINIA SRL.
Once the client has accepted a replacement property following a complaint, they shall have no further right to claim, request, or demand any compensation from ISLAND OF SARDINIA SRL or from the owner of the originally booked and subsequently replaced property.
Should the parties fail to reach an agreement regarding the replacement property, upon receipt of written notice of termination (cancellation) of the contract, ISLAND OF SARDINIA SRL shall refund the amounts already paid by the client, and no further sums or compensation shall be due from the company.
Under no circumstances shall ISLAND OF SARDINIA SRL be held liable for, nor required to cover, any expenses relating to hotel accommodation, changes to transport tickets, alternative lodgings, or other similar costs.
POOL AND GARDEN MAINTENANCE
Garden and pool maintenance is included in the rental price of the property. The Client acknowledges that the Owners or the appointed staff have the right to access the property periodically during the rental period to carry out their duties. These services are mandatory and, upon request, the property representative will communicate the schedule and frequency of the planned interventions, following a written request from the Client.
EXTRAORDINARY MAINTENANCE AND INTERVENTIONS
In the event of necessary and/or essential maintenance or extraordinary interventions required to ensure the smooth running of the holiday, Clients may not, under any circumstances, deny access to the Owners or property managers inside the property or dwelling.
It is understood that the Owners will always provide prior notice should the guests be unable to be present during the execution of the works, the Owners or their appointed staff may still enter the property, if necessary, in order to carry out urgent repair works.
PERSONAL DATA
All personal data provided by Clients will be processed in full compliance with Italian privacy laws and regulations, exclusively for the purposes related to the booking and stay management. For more details, please refer to the Privacy Policy available on the website: www.sardiniaunlimited.com.
LIMITATIONS OF LIABILITY
Clients acknowledge that many of the properties have inherent risks including unfenced swimming pools, dry stone walls, ungated access to roads, staircases, unsecured ledges, etc. Clients acknowledge that they are responsible for taking all necessary safety precautions for themselves and their guests, and neither Island of Sardinia Srl nor the Owners accept any liability for accidents causing death, sickness, or bodily harm, however caused.
The Company and Owners deny any liability or claims in the event of incidents occurring whilst occupants or guests are under the influence of alcohol or any non-therapeutic drugs.
The limitation of liability for any claim against the Company and the Owners of property, for whatsoever cause, is limited to the total amount of rental paid to the Company by the Client.
ACCEPTANCE OF TERMS AND CONDITIONS
Clients acknowledge that by accepting these terms and conditions in the Company’s inquiry form or booking request, they agree to be bound by the provisions contained herein and to accept liability for damages caused by them or their party to the Owners’ properties.
The rental agreement shall be governed by Italian law in every particular, including formation and interpretation. Any proceedings arising out of or in connection with this contract may be brought before a court of competent jurisdiction in Italy.
